Please read these Terms and Conditions carefully.

BY SUBMITTING AN APPLICATION FOR THE EXPERIENCED DREAMERS™ CONTEST (THE "CONTEST"), APPLICANTS FULLY AND UNCONDITIONALLY AGREE TO COMPLY WITH ALL OF THE TERMS AND CONDITIONS BELOW.


VOID WHERE PROHIBITED

The Contest is void in any state, county, or municipality where it is prohibited by law or regulation. All federal laws apply to the Contest except as otherwise designated below.


SPONSORS AND ELIGIBILITY

The Contest is sponsored by a partnership of government and community organizations including Allegheny County, the City of Pittsburgh, the Benedum Foundation, the Buhl Foundation, the Jewish Healthcare Foundation, the Pittsburgh Foundation, the Richard King Mellon Foundation, and the Heinz Endowments (collectively the "Sponsors"). The Contest is managed by Leadership Pittsburgh, Inc. (the "Manager"). Elected officials and current and past employees, officers, and directors of the Sponsors and Manager, as well as the immediate family members of such individuals, are not eligible to enter the Contest.


TERMS SUBJECT TO MODIFICATION

The Sponsors and Manager reserve the right to modify, cancel or limit the terms and conditions at their sole discretion, with or without notice to those who have applied or are planning to do so. Any modification will be listed on the ExperiencedDreamers.org website and all applicants and prospective applicants are solely responsible for checking the Terms and Conditions regularly to ensure compliance.


APPLICANT ELIGIBILITY

All applicants must meet the following criteria in order to be eligible for the Contest:

  • Have attained at least age forty-five (45) at the time of submission of their application,
  • Be a United States citizen or permanent legal resident of the United States (excluding United States territories and outlying areas,)
  • Live outside a one hundred (100) mile radius of downtown Pittsburgh, and
  • Have not lived within a one hundred (100) mile radius of Pittsburgh during the ten (10) years preceding the date on which their application is submitted.

CONTEST ENTRY PROCESS AND REQUIREMENTS

Applications for this Contest will be accepted during the period beginning at 12:00:01 a.m. on Wednesday, October 19, 2011 and ending at 11:59:59 p.m. on Friday, December 16, 2011. Applicants wishing to apply must do so online by visiting www.ExperiencedDreamers.org and completing and submitting the Application Form.

Judging will be conducted in accordance with the following three stages:

Stage 1: All complete entries will be read by a team of reviewers trained to consistently apply the selection criteria to each application. At the conclusion of Stage 1, the reviewers will narrow the field to twenty (20) semifinalists.

Stage 2: All semifinalists will be reviewed by a panel of judges using the same criteria used by the reviewers. At the conclusion of Stage 2, the judges will narrow the field to five (5) finalists.

Stage 3: All finalist applications will be summarized and placed online for a public vote by the people of Pittsburgh. All finalists will be notified of the public voting period. The finalist with the most votes at the conclusion of the public voting period will be declared the winner of the Contest.

Applicants must conform to the word limitation requirements set forth in the Application Form. Any Application Form exceeding those limits or those that include videos or other supplemental support material will be automatically eliminated from consideration. Applicants submitting more than one Application Form for the same dream will be automatically eliminated.

The Sponsors and Manager reserve the right to modify this process at any time.

If the winner does not meet all conditions, as set forth below, the prize will be awarded to the finalist with the second highest public vote count. If that person is not able to meet the conditions, it will move to the third highest, and so on until all five finalists are given the opportunity to meet the conditions. If none of the finalists are able to comply, the Contest will be declared null and void and all Prize money will be retained by the Sponsors.


JUDGING CRITERIA

All applicants understand that the selection of the semifinalists and finalists will be based solely on the reviewers' and judges' opinion of the originality, creativity, passion, and clarity demonstrated in the Application Form. Applicants further understand that such judgments will be subjective and within the sole and complete discretion of the reviewers and judges. All decisions by reviewers and judges are final. All proposed dreams must be legal within all federal, state, and local laws.


CONTEST AWARD AND PRECONDITIONS

The prize awarded to the winner of this Contest will be $50,000 in cash plus $50,000 in a donor controlled fund for charitable donations to be established at the Pittsburgh Foundation.

The $50,000 cash must be used to further realization of the dream and will be given to the winner after the winner has established permanent residence in the City of Pittsburgh. The cost of the move will be entirely at the winner's expense and legal residency must be established by December 31, 2012.

The $50,000 donor controlled fund for charitable donations will be established in the winner's name after one (1) year of continuous residency in the City of Pittsburgh. Donations from the trust will be restricted to human services, health, and/or arts and culture organizations with valid 501(c)(3) designations situated in Allegheny County, Pennsylvania. The detailed terms and conditions for this charitable fund will be established between the winner and the Pittsburgh Foundation.

Any preconditions not met by the winner will void that portion of the prize.

The Sponsors and Manager reserve the right to add additional amenities and/or conditions to this Contest at their sole discretion at any time and without notice.

All finalists must agree to provide their Social Security number to the Sponsors and Manager and to an authorized and bonded agency selected by Sponsors and Manager for a background check and for tax reporting purposes. Failure to comply with this requirement will automatically eliminate the finalist from further consideration.

Any inaccurate statements discovered on the Application Form will result in the applicant's immediate elimination from the Contest and, if the winner, revocation of the prize.


TAX CONSIDERATION

There may be some tax implications for applicants and the winner of the Contest. The Sponsors recommend that applicants review their Application Form and these Terms and Conditions with their legal/tax advisor to determine their potential tax liability, if any, in connection with winning the Contest. If there is any tax liability, it shall be the sole responsibility of the applicants.


CONTEST TIMETABLE

  • Application Period: Application Forms accepted between Wednesday, October 19 and Friday, December 16, 2011
  • Stages 1 and 2: Review and Judging – January 2012 through March 2012
  • Stage 3: Public online vote – April 2012
  • Winner announced at the conclusion of Stage 3 – April 2012

GENERAL CONDITIONS OF PARTICIPATION

All Application Forms and the contents therein become the exclusive property of the Sponsors and Manager and will not be returned. All applicants who are selected as semifinalists or finalists hereby agree that the Sponsors and Manager may use, in perpetuity and without notice or compensation, their name, likeness, pictures, photographs, voice, information from their applications, and statements for the purposes of promotion, advertising, and publicity.


LIMITATIONS OF LIABILITY, RELEASE, AND WAIVER

By entering the Contest, each applicant irrevocably agrees and acknowledges to be bound by the Terms and Conditions and all applicable laws of any applicable jurisdiction and decisions of the reviewers, judges, and any Sponsor or Manager which are final and binding in all respects; to forever and irrevocably waive all of his/her rights to claim ambiguity with respect to the Terms and Conditions and to waive all of his/her rights to bring any claim, action, or proceeding against any individual or entity involved in this Contest, including but not limited to the Sponsors and Manager; and to forever and irrevocably release, indemnify, and hold harmless the Sponsor and Contest Manager and their respective officers, directors, employees, or agents including outside attorneys, shareholders, representatives, successors, and assigns from any liability (including, but not limited to, liability for defamation, libel, slander, invasion of privacy, infringement of publicity or any intellectual property rights, any property loss, damage, personal injury, bodily injury, death, expense, accident, delay, inconvenience or irregularity, and any indirect, incidental, consequential, special, punitive or exemplary damages of any kind), costs and expenses (including, without limitation, reasonable outside attorneys' fees) that may arise from, result from, or are in connection with: (a) the Contest including, but not limited to, any Contest-related activity or element thereof and the applicants entry, participation, or inability to participate in the Contest; (b) the violation of any privacy, personal, publicity or proprietary rights; (c) typographical errors in these Terms and Conditions or any Contest promotional materials; (d) any change in the prizing (or any components thereof) due to unavailability, business or creative considerations, or due to reasons beyond the control of the sponsors or project manager or as otherwise permitted in these Terms and Conditions; (e) any interruptions in or postponement, cancellation, or modification of the Contest; (f) human error; (g) incorrect or inaccurate transcription, receipt, or transmission of any part of the Contest entry; (h) any system, computer timing and/or dating mechanism, computer equipment, software, or Internet service provider utilized by the sponsors, project manager or by an applicant; (i) interruption or inability to access the Contest, the ExperiencedDreamers.org website, or any other Contest-related web pages or any online service via the internet due to hardware or software compatibility problems; (j) any damage to applicant (or any third person's) computer and/or its contents related to or resulting from any part of the Contest; (k) any lost/delayed data transmissions, omissions, interruptions, defects, and/or any other destroyed, incomplete, undeliverable or damaged Contest entries; (l) any wrongful, negligent, or unauthorized act or omission on the part of the sponsors, project manager, or any of their agents or employees; or (m) the public voting or the tabulation of the votes.

By entering the Contest, the applicant waives any right to confidentiality or privacy regarding the content of the application.


SEVERABILITY

Each provision of these Terms and Conditions is independent and severable from the others, and no provision will be rendered unenforceable as a result of any other provision(s) being held to be invalid or unenforceable in whole or in part. If any provision(s) of these Terms and Conditions is invalid, unenforceable or too board, such provision(s) will be appropriate limited and reformed to the maximum extent permitted by applicable law.


MISCELLANEOUS

These Terms and Conditions are binding on applicants, voters and their heirs, administrators, executor, successors and assigns. The construction, validity, interpretation and enforceability of the Terms and Conditions of the Contest will be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania without giving effect to any choice of law or conflict of law rules. By submitting an Application Form, applicants consent to the jurisdiction and venue of the federal, state and local courts located in Allegheny County, Pennsylvania. These Terms and Conditions constitute the entire agreement with all applicants and supersede any and all prior or contemporaneous communications, representations or agreements, either verbal or written, between the parties with respect to the Contest. The Sponsors reserve the right to amend, supplement or otherwise modify these Terms and Conditions at any time.
